Terms of Service

Welcome to My Treat. These Terms of Service ("Terms") govern your access to and use of the My Treat mobile application and website (collectively, the "Service"), operated by My Treat ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We verify age during account registration and reserve the right to terminate accounts that do not meet this requirement.

2. Account Registration

To access most features, you must create an account by providing accurate information including your name, email address, date of birth, and home city. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@mytreat.club if you suspect unauthorized access.

My Treat is a social platform that helps people discover and organize group activities in their city. The Service allows users to:

You retain ownership of content you submit to the Service (photos, text, reviews). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating and promoting the Service. We may remove content that violates these Terms or our Community Guidelines without notice.

6. Trust Score and Moderation

The Service maintains a trust score system to promote safe interactions. Your trust score may be affected by reviews from other users, cancellation behavior, and moderation actions. We reserve the right to suspend, mute, or ban accounts that violate our policies. Moderation decisions are at our sole discretion.

To support safety, moderation, abuse investigation, dispute resolution, and legal compliance, authorized My Treat personnel and automated systems may review content you submit through the Service, including direct messages between users and messages exchanged with sponsor venues through the Platform's inbox. We treat the substance of these communications as confidential and do not sell or share it with third parties, except (a) with service providers acting on our behalf solely to operate the Service, (b) as required by law or legal process, or (c) to protect the safety of users or the integrity of the Service. 7. Paid Experiences

For "Paid Experience" posts, payment is collected directly at the venue or between participants. My Treat does not process, collect, or hold any payments between users for activities. We are not responsible for disputes arising from financial transactions between users.

If you host a Paid Experience or any group plan at a public venue, you are responsible for confirming with the venue, in advance, that it can accommodate your group at the date, time, and capacity you have posted. The host's confirmation of venue availability is required at posting time and shifts venue-availability liability to the host. My Treat does not contact venues on a host's behalf.

If a guest believes a Paid Experience was not as described, the host did not show up, or there is otherwise a financial or experience dispute, the guest's recourse is (a) to seek a refund or resolution directly from the host, and (b) to use the in-app Report function to flag the host for our review. Reports may result in trust-score adjustments, account suspension, or removal at our sole discretion. We do not arbitrate or guarantee financial outcomes between users.

Cancellations driven by severe weather or force-majeure events do not impact the host's trust score. Hosts are encouraged to communicate weather-related cancellations through the in-app chat and use the "Weather / Force Majeure" cancellation reason so guests are notified promptly.

8. Premium Subscriptions

We may offer optional premium subscription features ("Premium") for a recurring fee. Premium subscriptions are billed through the app store from which you downloaded the application (Google Play or Apple App Store). Subscription terms, pricing, and billing are governed by the respective app store's terms. You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.

Premium features are provided "as is" and may be modified or discontinued. No refunds are provided for partial billing periods except as required by applicable app store policies.

9. Sponsored Content

The Service may display sponsored content from businesses and venues. Sponsored content is clearly labeled. Inclusion of sponsored content does not constitute our endorsement of any business, venue, or promotion.

10. Safety and Disclaimer

My Treat provides a platform for connecting people. We do not guarantee the identity, conduct, or reliability of any user. You are solely responsible for your safety when meeting other users in person. We strongly recommend:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL LIABILITY FOR ANY HARM, LOSS, OR DAMAGE ARISING FROM YOUR USE OF THE SERVICE OR INTERACTIONS WITH OTHER USERS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY TREAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PREMIUM FEATURES IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or our Community Guidelines. You may delete your account at any time by contacting support@mytreat.club. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability) will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Hillsborough County, Florida.
